NUDGE TERMS & CONDITIONS

We know reading terms and conditions isn't the most exciting part of joining a gym, but we want to be completely transparent with you from day one. Here are the most important things you need to know before we dive into the details:

• All monthly memberships have a clear 1 calendar months notice period to cancel
• Memberships that are paid in full/upfront are non-refundable
• Memberships cannot be frozen or paused
• All usage limits reset on 1st of each month

PLEASE READ EVERY WORD OF THIS CONTRACT

By completing payment you are confirming that you have read, understood and are agreeing to the terms & conditions and cancellation policies outlined below.

These terms and conditions are entered into by and between Nudge Fitness (hereinafter: "Nudge") and You (hereinafter: "the Member" "I").

1.0 GENERAL

1.1 All contracts must be paid for in advance. Memberships will not be confirmed until payment has been received.

1.1.1 All memberships are personal, and cannot be shared.

1.2 I understand there are inherent risks in participating in a programme of strenuous exercise. If I sustain or claim to sustain any injury while participating in the programme, I acknowledge that Nudge Fitness and the coaching team are not responsible – except where the injury was caused by gross negligence or by an intentional act of the coach.

1.3 I confirm that that I (the member) does not suffer from health problems that would hinder exercise or prevent him/her from engaging in exercise, or that would be detrimental or adverse to the Member's health, safety or physical condition if he/she did exercise. In case of any doubt, the Member shall seek advice by a medical doctor who should confirm the ability to exercise.

1.4 I understand Nudge Fitness shall have no obligation to perform a fitness assessment or similar testing to determine the Member's physical condition. If an assessment is done at Nudge Fitness. it is for the sole purpose of compiling comparative data in order to track the Member's progress in a programme and not for diagnostic purposes.

Liability:

1.5 Each Member of Nudge Fitness shall be liable for any property damage and/or personal injury caused by the Member on the Nudge Fitness premises. It shall be the obligation of the Member to pay for any costs involved upon presentation of a statement thereof.

1.6 I understand my progress is dependent upon my effort, cooperation, consistency, and adherence to the programme both inside and outside of the training sessions themselves.

28 DAY TRIAL & ALL OTHER PROGRAMMES

1.8 Your 28 Day Kickstart consists of 28 consecutive days of coaching and nutrition education at Nudge Fitness, just outside Woking.

1.9 I understand that in order to be eligible for any guaranteed results (if applicable) I must attend at least 3 coaching sessions a week at Nudge Fitness (every week) whilst completing all the action steps outlined in the Members Nutrition guidance.

2.0 CONTRACT DURATION & RENEWAL

The last thing we wanted to do was to put people into 12 month contracts that you can't get out of. We think giving us a clear 1 calendar months notice to cancel your membership is fair, and we'd love for you to continue to train with us right up until that point.

There is a 1 calendar month cancellation period.

2.1 I understand that by completing payment and agreeing on this contract I commit myself to the minimum membership cancellation period of a clear 1 calendar months notice from the day acknowledged by Nudge Fitness staff.

3.0 PAYMENTS

3.1 The Member agrees to pay monthly recurring fees as follows: As appropriate for the selected membership for every month's membership at Nudge Fitness via recurring card payment through the Stripe payment system.

5.0 CANCELLATIONS

5.1 Following the minimum notice period of a clear 1 calendar month, all membership cancellations are subject to authorisation by Nudge Fitness, we endeavour this to be 24-48 hours.

5.2 Cancellation of a contract prior to the expiration of the minimum notice period requires an early termination fee equal to 100% of the remainder of the 1 calendar month agreement.

We have bills and staff members to pay too. We keep our word on everything we promise to deliver here at Nudge Fitness so we expect you to hold up your end of the bargain by honouring this cancellation policy. We believe it is very fair.
